Terms and Conditions

1. ACKNOWLEDGMENT AND ASSUMPTION OF RISKS
I understand that participation in a golf tournament and related activities (including practice rounds, driving range use, golf cart use, social functions, and awards ceremonies) involves inherent and other risks including, but not limited to:

• Being struck by golf balls or golf clubs
• Golf cart collisions, rollovers, or misuse
• Uneven terrain, wet grass, bunkers, and natural hazards
• Weather conditions including lightning, extreme heat, or wind
• Physical exertion
• Acts or omissions of other participants, spectators, volunteers, or staff

I knowingly and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of the Released Parties (as defined below), to the fullest extent permitted under Washington law.

2. RELEASE AND WAIVER OF LIABILITY
In consideration of being allowed to participate in WSG club events, I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby:
Release, waive, discharge, and covenant not to sue the following:
WSG, the golf courses owner/operators, tournament sponsors, affiliates, directors, officers, employees, volunteers, agents, and representatives (collectively, the “Released Parties”)
from any and all claims, demands, losses, or liability for injury, disability, death, or property damage arising out of or related to my participation in the event, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, to the fullest extent permitted by Washington law.
This release does not apply to gross negligence or willful or wanton misconduct where such release is prohibited by law.

3. INDEMNIFICATION
I agree to indemnify and hold harmless the Released Parties from any claims, damages, costs, or expenses (including attorney fees) arising out of my participation in the event or my actions during the events.

4. MEDICAL CONSENT
I certify that I am physically capable of participating. I authorize the Released Parties to obtain emergency medical care if necessary and agree to be financially responsible for any such care.

5. RULES AND CONDUCT
I agree to:

• Follow all WSG club rules, tournament rules and posted course rules
• Operate golf carts safely and in accordance with course policy
• Comply with golf course rules and regulations
• Comply with Washington State laws regarding alcohol consumption
• Conduct myself in a safe and respectful manner

The Club and participating golf facilities reserves the right to remove any participant for unsafe conduct without refund.

6. PHOTO AND MEDIA RELEASE
I grant permission to the Club and sponsors to use photographs, video, or other recordings of me taken during the event for promotional purposes without compensation. Contact us if you wish to decline media consent.

7. GOVERNING LAW AND VENUE
This Agreement shall be governed by the laws of the State of Washington.
Venue for any dispute shall lie exclusively in the courts of the State of Washington located in Whatcom County.

8. SEVERABILITY
If any provision of this Agreement is held invalid, the remaining provisions shall remain in full force and effect.

9. ACKNOWLEDGMENT OF UNDERSTANDING
I HAVE READ THIS AGREEMENT CAREFULLY. I UNDERSTAND THAT BY SIGNING IT, I AM RELEASING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I ACKNOWLEDGE ABD AGRRE WITH THIS AGREEMENT VOLUNTARILY.

10. Membership Non-Refundable. Upon activation of your membership, all payments are final and non-refundable. Should you choose to terminate your membership, or if your membership is terminated for cause by Whatcom Seniors Golf, you will not be entitled to a refund of any unused portion of the membership dues or prepaid fees.
